1. Introduction
Welcome to INTRO Card Ltd. ("INTRO", "Company", "we", "our", or "us").
These Terms of Service ("Terms") govern your access to and use of INTRO's products, software, websites, mobile applications, digital profiles, cloud services, NFC-enabled smart business cards, QR-based services, enterprise solutions, APIs, subscriptions, and any other services we provide (collectively, the "Services").
These Terms form a legally binding agreement between you and INTRO Card Ltd.
By purchasing, activating, accessing, registering for, or using any INTRO product or Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you must not purchase or use our Services.
These Terms apply whether you purchase directly from INTRO, through an authorized reseller, corporate partner, distributor, or any approved sales channel.
Our Privacy Policy, Cookie Policy, Warranty Policy, Refund Policy, Shipping Policy, and any additional service-specific policies are incorporated into these Terms by reference.
2. About INTRO
INTRO Card Ltd. is a technology company specializing in NFC-enabled smart business cards, digital identity solutions, professional networking technologies, cloud-hosted digital profiles, and related software services.
INTRO continuously develops and improves its products and services. As technology evolves, some features may be modified, improved, replaced, discontinued, or newly introduced.
Nothing in these Terms guarantees that every current feature will remain available indefinitely.
3. Acceptance of Terms
You accept these Terms when you:
- purchase an INTRO product;
- activate an INTRO Smart Card;
- create an INTRO account;
- create or claim a Digital Profile;
- scan an INTRO QR Code;
- use our website;
- access our dashboard;
- subscribe to our Services;
- use any enterprise solution;
- continue using the Services after these Terms are updated.
If you use the Services on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
4. Definitions
For purposes of these Terms:
Account means a registered INTRO user account.
Authorized User means an individual permitted to use the Services by an organization or account owner.
Customer means the individual or organization purchasing INTRO products or Services.
Digital Profile means the cloud-hosted webpage, digital identity, contact profile, or professional information created through INTRO.
Enterprise Account means an account created for businesses, institutions, or organizations.
INTRO Card means any NFC-enabled smart business card, metal card, PVC card, accessory, or physical networking product manufactured or sold by INTRO.
Profile Data means the information uploaded by users, including names, contact information, social media links, websites, images, company details, and other content.
Services means all products, software, cloud platforms, websites, applications, APIs, dashboards, enterprise solutions, subscriptions, digital profiles, and future services provided by INTRO.
Subscription means any recurring paid service offered by INTRO.
Website means all official INTRO-owned websites and domains.
You means the individual or legal entity using our Services.
5. Eligibility
You may use our Services only if:
- you are legally capable of entering into a binding agreement;
- your use complies with applicable laws;
- the information you provide is accurate and complete;
- you are not prohibited from using our Services under applicable law.
If you create an account on behalf of an organization, you confirm that you are authorized to do so.
INTRO may refuse service where prohibited by law.
6. Business Customers
Organizations purchasing INTRO products for employees remain responsible for:
- managing employee accounts;
- assigning Smart Cards;
- verifying administrators;
- complying with these Terms.
Corporate administrators may manage employee access according to Enterprise policies.
Additional Enterprise Terms may apply.
7. User Accounts
Certain Services require an INTRO account.
When creating an account, you agree to:
- provide accurate information;
- keep information updated;
- maintain the confidentiality of your credentials;
- protect your login information;
- immediately notify INTRO of unauthorized access.
You remain responsible for activities occurring under your account unless caused by INTRO's negligence.
INTRO may require identity verification before restoring account access.
Verification may include:
- government-issued identification;
- email verification;
- phone verification;
- one-time passwords (OTP);
- purchase records;
- corporate authorization;
- any additional verification reasonably required to protect account security.
INTRO reserves the right to refuse recovery requests where ownership cannot be reasonably verified.
8. Account Security
You must not:
- share passwords;
- share administrator credentials;
- create fraudulent accounts;
- impersonate another individual;
- create accounts using false identities.
INTRO may suspend accounts posing security risks.
9. Account Suspension
INTRO may temporarily suspend or permanently terminate an account if we reasonably believe:
- these Terms have been violated;
- fraudulent activity has occurred;
- payment obligations remain unpaid;
- identity cannot be verified;
- the account creates security risks;
- the Services are being misused;
- applicable laws require suspension.
Where practical, INTRO will provide notice before permanent termination, except where immediate action is necessary to protect users, the Services, or comply with legal obligations.
10. Product Orders
Customers may place orders through:
- INTRO's official website;
- authorized distributors;
- corporate sales;
- approved marketplaces;
- official social media channels;
- other authorized sales channels.
All orders remain subject to acceptance by INTRO.
INTRO reserves the right to reject or cancel any order for reasons including:
- pricing errors;
- inventory limitations;
- suspected fraud;
- payment verification failure;
- shipping restrictions;
- regulatory requirements;
- technical errors.
11. Product Availability
Product availability may change without notice.
INTRO does not guarantee continuous availability of every product, color, material, edition, feature, or accessory.
Products may be modified or discontinued at any time.
12. Pricing
Prices displayed by INTRO are subject to change without prior notice.
Applicable taxes, VAT, delivery charges, customs duties, or regulatory fees may apply depending on the jurisdiction.
Pricing errors may occasionally occur.
If a pricing error materially affects an order, INTRO may cancel the order and issue a full refund.
13. Payment
Customers agree to pay all applicable charges associated with their purchases.
INTRO accepts payment methods that may include:
- debit cards;
- credit cards;
- bank transfers;
- mobile financial services;
- digital wallets;
- approved payment gateways;
- other authorized payment methods.
Payment processing may be handled by third-party payment providers.
INTRO does not store full payment card information unless expressly stated.
14. Payment Authorization
By submitting payment information, you represent and warrant that:
- you are authorized to use the selected payment method;
- payment information is accurate;
- sufficient funds are available;
- payment authorization has been granted.
INTRO may verify payment before processing an order.
15. Fraud Prevention
To protect customers and the integrity of the Services, INTRO may perform fraud prevention measures, including:
- payment verification;
- address verification;
- identity verification;
- duplicate order detection;
- transaction monitoring;
- manual review.
Orders suspected of fraud may be delayed, cancelled, or refused.
16. Corporate Orders
Bulk purchases made by businesses may be governed by separate commercial agreements.
Where a separate written agreement exists, that agreement will prevail in the event of any conflict with these Terms.
17. Future Paid Services
Certain Services are currently provided without recurring fees.
INTRO reserves the right to introduce new paid features, premium plans, enterprise subscriptions, API pricing, storage limits, or other commercial offerings in the future.
Such changes will not affect existing contractual commitments unless expressly stated.
No provision in these Terms guarantees that every current feature will remain free forever.
18. INTRO Smart Cards
INTRO designs, manufactures, distributes, and sells NFC-enabled Smart Business Cards and related networking products (collectively, "Smart Cards").
Depending on the product purchased, Smart Cards may include one or more of the following features:
- NFC technology
- Dynamic QR Codes
- Digital Profile integration
- Cloud-based profile hosting
- Contact sharing
- Website links
- Social media links
- Portfolio sharing
- Business information
- Analytics (where available)
- Enterprise management features
- Future software enhancements where applicable
The specific features available to you depend on the product, plan, subscription, and Services purchased.
19. Ownership of Physical Smart Cards
Once full payment has been received, ownership of the physical Smart Card transfers to the purchaser.
Ownership of the physical Smart Card does not transfer ownership of:
- INTRO software;
- cloud infrastructure;
- Digital Profile platform;
- databases;
- APIs;
- NFC technologies;
- QR technologies;
- trademarks;
- branding;
- proprietary software;
- intellectual property.
Customers purchase a physical networking product together with a license to use INTRO's digital Services under these Terms.
20. Activation of Smart Cards
Certain Smart Cards require activation before use.
Activation may require:
- account creation;
- email verification;
- mobile verification;
- profile setup;
- identity verification;
- administrator approval (Enterprise Accounts).
INTRO reserves the right to refuse activation where fraud, abuse, or unlawful activity is reasonably suspected.
21. Digital Profiles
A Digital Profile is a cloud-hosted webpage connected to an INTRO Smart Card or QR Code.
The Digital Profile may contain information voluntarily provided by the customer, including:
- name;
- company;
- designation;
- contact information;
- business address;
- websites;
- social media accounts;
- images;
- logos;
- documents;
- videos;
- location information;
- portfolio links;
- other professional information.
The customer is solely responsible for the accuracy, legality, and completeness of all information published.
22. Public Nature of Digital Profiles
Unless specifically configured otherwise by INTRO, Digital Profiles are intended to be publicly accessible.
By publishing information within a Digital Profile, you understand and agree that:
- anyone who scans your Smart Card or QR Code may access your profile;
- your profile URL may be shared by third parties;
- search engines may index publicly available profile information where technically permitted;
- INTRO cannot control who accesses publicly available information after it has been shared.
Customers should avoid publishing confidential, sensitive, or private information unless they intentionally wish to make it publicly accessible.
23. Ownership of Profile Data
You retain ownership of the content and information you upload to your Digital Profile.
However, by uploading content, you grant INTRO a worldwide, non-exclusive, royalty-free license to:
- host;
- store;
- reproduce;
- display;
- transmit;
- process;
- format;
- backup;
- optimize;
your content solely for the purpose of operating, maintaining, securing, improving, and providing the Services.
This license automatically ends when your content is permanently removed from our systems, subject to backup retention requirements and applicable law.
24. Ownership of the Platform
While customers own their uploaded information, INTRO exclusively owns and retains all rights relating to:
- software;
- source code;
- databases;
- designs;
- interface;
- infrastructure;
- NFC programming;
- QR technology;
- platform architecture;
- trademarks;
- branding;
- analytics systems;
- security systems;
- artificial intelligence features;
- proprietary algorithms;
- future improvements.
Nothing contained within these Terms transfers ownership of INTRO intellectual property to any customer.
25. Cloud Hosting Services
INTRO currently hosts Digital Profiles through its cloud infrastructure.
Cloud hosting is provided to enable customers to access their Digital Profiles online.
Although INTRO intends to maintain reliable Services, uninterrupted access cannot be guaranteed.
Temporary interruptions may occur due to:
- scheduled maintenance;
- emergency maintenance;
- software updates;
- hardware failures;
- internet outages;
- cloud provider issues;
- cybersecurity incidents;
- force majeure events;
- regulatory actions;
- circumstances beyond INTRO's reasonable control.
INTRO will use commercially reasonable efforts to restore Services as quickly as practicable.
26. Service Availability
INTRO aims to provide reliable cloud Services.
However, we do not guarantee:
- uninterrupted availability;
- continuous uptime;
- permanent compatibility with every device;
- compatibility with future operating systems;
- compatibility with third-party applications.
Services evolve over time.
Features may be improved, modified, replaced, or discontinued.
27. Long-Term Availability of Digital Services
INTRO is committed to operating its Digital Profile platform as a long-term commercial service.
However, no cloud-based technology service can reasonably be guaranteed to remain available forever.
Unless expressly agreed in writing, customers acknowledge that:
- Digital Profile hosting is provided while INTRO continues to operate the applicable Service;
- INTRO does not guarantee perpetual or lifetime availability of any cloud-based Service;
- future Services may evolve into subscription-based or enterprise offerings;
- some features may become premium features over time.
Nothing in these Terms shall be interpreted as creating a perpetual obligation upon INTRO to provide unlimited cloud hosting without commercial, technical, or legal limitations.
28. Business Continuity and Service Discontinuation
If INTRO permanently discontinues the Digital Profile Service because of:
- business closure;
- merger;
- acquisition;
- insolvency;
- legal requirements;
- regulatory restrictions;
- force majeure;
- commercial restructuring;
- technological obsolescence;
- circumstances beyond INTRO's reasonable control,
INTRO will use commercially reasonable efforts to:
- provide advance notice where practicable;
- notify customers through reasonable communication channels;
- allow customers a reasonable opportunity to export available profile information where technically feasible.
Customers acknowledge that permanent continuation of cloud-hosted Services cannot be guaranteed indefinitely.
29. Twenty-Four (24) Month Limited Warranty
INTRO provides a Limited Warranty covering manufacturing defects in eligible Smart Cards for a period of twenty-four (24) months from the original delivery date.
This warranty applies only to defects resulting from normal intended use.
During the Warranty Period, INTRO may, at its sole discretion:
- repair the product;
- replace the product;
- replace only the NFC component;
- provide an equivalent replacement product.
The chosen remedy shall constitute the customer's exclusive warranty remedy.
30. Warranty Coverage
The Limited Warranty generally covers:
- manufacturing defects;
- NFC chip failure under normal use;
- internal programming defects;
- production-related faults;
- factory defects preventing intended operation.
INTRO reserves the right to inspect the product before approving any warranty claim.
31. Warranty Exclusions
The Limited Warranty does not cover:
- lost cards;
- stolen cards;
- bent cards;
- cracked cards;
- broken cards;
- scratches;
- dents;
- fading;
- discoloration;
- cosmetic damage;
- misuse;
- abuse;
- negligence;
- liquid damage;
- fire damage;
- chemical exposure;
- excessive heat;
- unauthorized modification;
- drilling;
- cutting;
- hole punching;
- improper storage;
- damage caused by third-party accessories;
- intentional damage;
- normal wear and tear.
Any damage resulting from improper use may void the warranty.
32. Lost or Stolen Smart Cards
Customers must immediately notify INTRO if a Smart Card is lost or stolen.
Upon successful verification, INTRO may:
- deactivate the previous card;
- prevent future activation of the lost card;
Once permanently deactivated, a lost or stolen Smart Card cannot be reactivated.
33. Replacement Policy
INTRO does not provide replacement Smart Cards for loss, theft, accidental damage, misuse, cosmetic wear, or any other customer-related reason.
A replacement Smart Card will only be provided where INTRO determines that the product contains a verified manufacturing defect or an NFC hardware malfunction covered under the applicable Limited Warranty. Warranty claims must be reported within the applicable warranty period and are subject to inspection and approval by INTRO.
If a warranty claim is approved, INTRO may, at its sole discretion, repair or replace the defective Smart Card with the same or an equivalent product.
If a Smart Card is lost, stolen, physically damaged, or becomes unusable for reasons not covered by the Limited Warranty, the customer must purchase a new Smart Card at the price applicable at the time of purchase. Such cases are not considered warranty replacements and do not qualify for a free replacement.
34. Profile Recovery and Ownership Verification
To protect customers against fraud and unauthorized access, INTRO may require reasonable verification before transferring or restoring ownership of a Digital Profile.
Verification may include:
- government-issued identification;
- registered mobile number verification;
- registered email verification;
- one-time password (OTP);
- purchase records;
- payment confirmation;
- company authorization (for Enterprise Accounts);
- any additional information reasonably necessary to verify ownership.
Failure to successfully complete verification may result in denial of the recovery request.
35. Replacement Smart Cards and Digital Profiles
Each INTRO Smart Card is independently associated with a Digital Profile created during its activation.
If a Smart Card is lost, stolen, damaged, or replaced for any reason, the previously created Digital Profile cannot be transferred, migrated, restored, or linked to the replacement Smart Card.
Customers purchasing a replacement Smart Card must create a new Digital Profile during the activation process. Any information from a previous Digital Profile must be entered again by the customer.
36. Technical Support
INTRO provides customer support through officially designated communication channels.
Support availability, response times, and service levels may vary depending on:
- product type;
- warranty status;
- subscription plan;
- enterprise agreement;
- business hours;
- regional availability.
INTRO does not guarantee resolution within any specific timeframe unless expressly agreed in writing.
37. Future Service Enhancements
INTRO continuously develops new technologies and may introduce:
- premium Digital Profile features;
- enterprise dashboards;
- AI-powered tools;
- analytics;
- API integrations;
- automation features;
- storage upgrades;
- collaboration tools;
- additional networking capabilities.
Access to future features may require separate purchases or subscriptions and may be governed by additional terms.
38. User Content
Certain INTRO Services allow users to create, upload, publish, store, or share content through their Digital Profiles or other Services.
User Content may include, but is not limited to:
- Name
- Profile photo
- Company logo
- Business information
- Phone numbers
- Email addresses
- Website links
- Social media links
- Portfolio
- Documents
- Images
- Videos
- Marketing materials
- Product information
- Location details
- QR-linked resources
- Any other information submitted by the user.
You are solely responsible for all User Content that you upload or publish.
39. Responsibility for User Content
You represent and warrant that:
- You own the content you upload or have all necessary rights and permissions to use it.
- Your content does not violate any law.
- Your content does not infringe any copyright, trademark, patent, trade secret, privacy, publicity, or other legal rights.
- Your content is accurate and not intentionally misleading.
- Your content does not contain malware or harmful code.
INTRO does not verify the accuracy of user-generated information and is not responsible for its completeness or legality.
40. Content Moderation
INTRO reserves the right, but not the obligation, to review, monitor, restrict, suspend, edit, remove, or disable access to User Content that, in our reasonable judgment:
- violates these Terms;
- violates applicable laws;
- infringes intellectual property rights;
- creates security risks;
- promotes fraud or deception;
- damages INTRO's reputation;
- interferes with the operation of our Services.
Removal of content does not create any obligation for INTRO to monitor all user activity.
41. Acceptable Use
You agree to use the Services only for lawful, ethical, and legitimate business or personal networking purposes.
You must not use INTRO Services to:
- impersonate another person or organization;
- create fake identities;
- commit fraud;
- conduct phishing activities;
- distribute spam;
- spread malware;
- distribute ransomware;
- promote illegal products or services;
- facilitate money laundering;
- engage in identity theft;
- operate fraudulent investment schemes;
- distribute illegal software;
- violate sanctions or export laws;
- engage in cybercrime;
- conduct illegal gambling;
- promote terrorism or violent extremism;
- publish child exploitation material;
- distribute obscene or unlawful content;
- violate consumer protection laws;
- violate privacy laws.
Any such use may result in immediate suspension or termination.
42. Prohibited Technical Activities
You must not:
- reverse engineer INTRO software;
- decompile any application;
- bypass security controls;
- access unauthorized systems;
- scrape profile data using automated tools;
- crawl the platform without authorization;
- attempt denial-of-service attacks;
- interfere with network operations;
- inject malicious code;
- exploit vulnerabilities;
- attempt unauthorized API access;
- interfere with cloud infrastructure.
Any attempt to compromise platform security may result in immediate legal action.
43. Anti-Spam Policy
Digital Profiles may not be used for:
- bulk unsolicited messaging;
- mass email campaigns without consent;
- automated spam;
- deceptive advertising;
- fake lead generation;
- unsolicited commercial communications prohibited by law.
INTRO may suspend offending accounts without prior notice.
44. Fraud Prevention
INTRO actively monitors suspicious activities to protect customers and the platform.
INTRO may investigate activities including:
- unusual login behavior;
- suspicious profile transfers;
- payment fraud;
- account hijacking;
- identity theft;
- fake businesses;
- unauthorized card activation.
Where appropriate, INTRO may cooperate with payment providers, law enforcement agencies, regulators, and courts.
45. Corporate and Enterprise Accounts
Organizations purchasing INTRO products for employees may create Enterprise Accounts.
Unless otherwise agreed in writing, the purchasing organization shall be considered the primary account owner for Enterprise Services.
Corporate administrators may:
- assign Smart Cards;
- manage Digital Profiles;
- update employee information;
- deactivate users;
- reassign profiles;
- manage subscriptions;
- access administrative features.
Employees acknowledge that profiles created under an Enterprise Account may be managed by their employer.
46. Employee Departure
Where a Smart Card is issued under an Enterprise Account:
- ownership of the physical card shall follow the applicable purchase agreement;
- ownership of the Digital Profile shall be governed by the Enterprise Agreement;
- the employer may request reassignment, transfer, suspension, or deletion of employee profiles.
INTRO may require written authorization before processing such requests.
47. Intellectual Property
All rights relating to INTRO Services remain the exclusive property of INTRO and its licensors.
This includes, but is not limited to:
- software;
- platform architecture;
- databases;
- UI/UX;
- trademarks;
- logos;
- graphics;
- icons;
- source code;
- APIs;
- NFC programming;
- QR technologies;
- cloud infrastructure;
- documentation;
- business methods;
- proprietary technologies.
Nothing in these Terms transfers ownership of INTRO intellectual property to customers.
48. Trademark Rights
INTRO™, INTRO Card™, associated logos, product names, slogans, and branding are trademarks or registered trademarks of INTRO Card Ltd.
Customers may not use INTRO trademarks without prior written permission except as necessary to identify INTRO products.
49. Feedback
Customers may voluntarily submit:
- suggestions;
- ideas;
- recommendations;
- feature requests;
- product improvements;
- bug reports.
Unless otherwise agreed in writing, all feedback may be used by INTRO without restriction or compensation.
Submitting feedback does not create ownership rights or confidential obligations.
50. APIs and Developer Services
INTRO may provide APIs, developer tools, SDKs, integrations, or automation services.
Use of such services may require:
- developer registration;
- API credentials;
- separate agreements;
- usage limits;
- subscription fees.
INTRO may modify, suspend, rate-limit, or discontinue APIs at any time.
Unauthorized API use is prohibited.
51. Artificial Intelligence Features
INTRO may introduce artificial intelligence or machine learning features.
AI-generated outputs:
- may contain inaccuracies;
- should be independently verified;
- are provided for convenience;
- do not constitute professional advice.
Customers remain solely responsible for decisions based upon AI-generated outputs.
52. Privacy
INTRO values customer privacy.
Our collection, storage, processing, sharing, and protection of personal information are governed by our Privacy Policy.
By using our Services, you consent to the practices described in the Privacy Policy.
53. Customer Data
Customers retain ownership of their personal information and Profile Data.
INTRO processes Customer Data solely for purposes including:
- operating the Services;
- improving security;
- providing support;
- complying with legal obligations;
- improving product functionality.
INTRO does not sell personal information except where explicitly disclosed and permitted by applicable law.
54. Data Retention
INTRO retains customer information only for as long as reasonably necessary to:
- provide Services;
- maintain security;
- comply with legal obligations;
- resolve disputes;
- enforce agreements.
Inactive accounts or Digital Profiles may be archived or permanently deleted after an extended period of inactivity, subject to applicable law and INTRO's internal data retention policies.
Where reasonably practicable, INTRO may provide prior notice before permanent deletion.
55. Customer Responsibility for Backups
Customers are responsible for maintaining independent copies of important business information stored in their Digital Profiles.
Although INTRO maintains backup procedures, no backup system is infallible.
Customers should not rely exclusively upon INTRO as the sole repository of important business information.
56. Security
INTRO implements commercially reasonable administrative, technical, and organizational safeguards designed to protect customer information.
However, no internet-based system can be guaranteed to be completely secure.
Customers acknowledge the inherent security risks associated with internet communications.
57. Security Incidents
If INTRO becomes aware of a material security incident affecting customer information, INTRO will take commercially reasonable steps to:
- investigate the incident;
- contain the incident;
- restore affected systems;
- notify affected users where required by applicable law.
58. Third-Party Services
INTRO Services may integrate with third-party platforms including payment providers, social media platforms, mapping services, analytics providers, cloud infrastructure providers, communication platforms, and other external services.
INTRO is not responsible for:
- third-party availability;
- third-party security;
- third-party privacy practices;
- third-party content;
- third-party outages.
Your use of third-party services is governed by their own terms and policies.
59. Beta Features
From time to time INTRO may release experimental or beta features.
Beta features:
- may contain bugs;
- may change without notice;
- may be discontinued at any time;
- are provided "as available";
- may not be fully supported.
Customers use beta features at their own discretion.
60. Compliance with Laws
Customers agree to comply with all applicable:
- laws;
- regulations;
- sanctions;
- export controls;
- consumer protection requirements;
- tax obligations;
- privacy regulations;
- intellectual property laws;
applicable within their jurisdiction while using INTRO Services.
61. Disclaimer of Warranties
Except as expressly provided under INTRO's Limited Warranty or where otherwise required by applicable law, all Services, software, Digital Profiles, websites, cloud services, APIs, applications, and related technologies are provided on an "AS IS" and "AS AVAILABLE" basis.
To the fullest extent permitted by applicable law, INTRO disclaims all warranties, whether express, implied, statutory, or otherwise, including, without limitation:
- merchantability;
- fitness for a particular purpose;
- non-infringement;
- uninterrupted availability;
- error-free operation;
- compatibility with every device or operating system;
- uninterrupted network connectivity;
- continuous cloud hosting.
Nothing in these Terms excludes any rights that cannot legally be excluded under applicable law.
62. Limitation of Liability
To the maximum extent permitted by law, INTRO shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to the use of the Services.
This limitation includes, without limitation:
- loss of business;
- loss of profits;
- loss of revenue;
- business interruption;
- loss of customers;
- loss of opportunities;
- reputational damage;
- loss of goodwill;
- loss of contracts;
- loss of anticipated savings;
- corruption or loss of data;
- third-party claims.
63. Maximum Liability
Where INTRO is found legally liable, INTRO's total aggregate liability arising from a particular claim shall not exceed the amount actually paid by the customer for the specific product or Service giving rise to that claim during the twelve (12) months immediately preceding the event.
This limitation applies regardless of the legal theory asserted.
64. Customer Responsibility
Customers are solely responsible for:
- maintaining accurate profile information;
- protecting account credentials;
- complying with applicable laws;
- maintaining independent backups of important business information;
- ensuring lawful use of the Services;
- protecting confidential information they choose to publish.
INTRO shall not be responsible for customer negligence.
65. Indemnification
You agree to defend, indemnify, and hold harmless INTRO Card Ltd., its directors, officers, shareholders, employees, affiliates, distributors, partners, licensors, contractors, and agents from and against any claims, liabilities, losses, damages, judgments, penalties, costs, or expenses (including reasonable legal fees) arising from:
- your violation of these Terms;
- your misuse of the Services;
- your User Content;
- your violation of applicable law;
- infringement of third-party rights;
- fraudulent or unauthorized activities conducted through your account.
66. Force Majeure
INTRO shall not be liable for any delay, interruption, failure, or inability to perform its obligations where such delay or failure results from circumstances beyond its reasonable control.
Such circumstances include, but are not limited to:
- natural disasters;
- floods;
- earthquakes;
- fires;
- pandemics;
- epidemics;
- war;
- terrorism;
- civil unrest;
- government actions;
- regulatory restrictions;
- internet outages;
- cloud service failures;
- power failures;
- cyberattacks;
- labor disputes;
- transportation disruptions;
- shortages of materials;
- acts of God.
Performance shall resume as soon as reasonably practicable after such circumstances cease.
67. Business Continuity and Service Discontinuation
INTRO intends to operate its Digital Profile platform and related Services as a long-term commercial business.
However, customers acknowledge that no technology company can reasonably guarantee perpetual operation of cloud-based Services.
If INTRO permanently discontinues all or part of its Services due to:
- business closure;
- insolvency;
- merger;
- acquisition;
- restructuring;
- legal requirements;
- regulatory orders;
- technological obsolescence;
- force majeure;
- circumstances beyond INTRO's reasonable control,
INTRO will use commercially reasonable efforts, where practicable, to:
- provide advance notice through available communication channels;
- allow customers a reasonable opportunity to export available profile information where technically feasible;
- honor any legal obligations applicable at the time of discontinuation.
Nothing in these Terms shall be interpreted as requiring INTRO to provide cloud-hosted Services indefinitely or beyond the practical operation of its business.
68. Suspension and Termination of Services
INTRO may suspend, restrict, or terminate access to any Service immediately where necessary to:
- protect platform security;
- investigate fraud;
- comply with legal obligations;
- prevent misuse;
- protect other customers;
- maintain system integrity.
INTRO may also discontinue individual features, products, or Services as technology evolves.
69. International Use
INTRO Services may be accessed from various countries.
Customers are responsible for ensuring that their use of the Services complies with the laws of their own jurisdiction.
INTRO makes no representation that every Service is legally available in every country.
70. Export Compliance
Customers agree not to use, export, transfer, or provide INTRO products or Services in violation of applicable export control laws, sanctions regulations, or trade restrictions.
71. Assignment
Customers may not assign or transfer their rights or obligations under these Terms without INTRO's prior written consent.
INTRO may assign or transfer these Terms, in whole or in part, in connection with:
- mergers;
- acquisitions;
- business restructuring;
- sale of assets;
- corporate succession;
- financing arrangements.
72. Electronic Communications
By using INTRO Services, you consent to receive communications electronically.
Electronic communications may include:
- emails;
- SMS;
- in-app notifications;
- account notifications;
- service announcements;
- legal notices.
Electronic communications satisfy any legal requirement that communications be provided in writing, where permitted by law.
73. Notices
Official notices from INTRO may be provided through:
- the official website;
- registered email address;
- customer dashboard;
- mobile application;
- verified business communication channels.
Customers are responsible for maintaining current contact information.
74. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the People's Republic of Bangladesh, without regard to conflict of law principles.
75. Dispute Resolution
Before initiating legal proceedings, both parties agree to make reasonable efforts to resolve disputes through good-faith negotiations.
If a dispute cannot be resolved amicably, the parties may seek resolution through mediation where appropriate.
Any legal action arising from these Terms shall be brought before the competent courts located in Dhaka, Bangladesh, unless otherwise required by applicable law.
76. Changes to the Services
INTRO continuously improves its technology and reserves the right to:
- modify products;
- improve features;
- discontinue functionality;
- introduce new technologies;
- replace software components;
- redesign Digital Profiles;
- update security features.
Such changes do not constitute a breach of these Terms.
77. Changes to these Terms
INTRO may revise these Terms from time to time.
Material changes will become effective upon publication on our official website or through other reasonable notice methods.
Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
78. Entire Agreement
These Terms, together with the Privacy Policy, Refund Policy, Shipping Policy, Enterprise Terms (where applicable), and any additional written agreements between the parties, constitute the entire agreement relating to the Services.
They supersede all prior oral or written understandings concerning the subject matter.
79. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.
The unenforceable provision shall be interpreted or modified only to the extent necessary to make it enforceable while preserving its original intent wherever legally possible.
80. No Waiver
Failure by INTRO to enforce any right or provision under these Terms shall not constitute a waiver of that right or provision.
Any waiver shall be effective only if made expressly in writing by an authorized representative of INTRO.
81. Survival
The following provisions shall survive termination or expiration of these Terms:

- Payment Obligations
- Limitation of Liability

- Privacy Obligations
- Governing Law
- Dispute Resolution
- Confidentiality (where applicable)
- Data Retention obligations
- Any provision that by its nature is intended to survive termination.
